1. Provider and scope
Simon Tautz, sole proprietor, trading as JustSendIt Albert-Roßhaupter-Straße 70, 81369 München, Germany simon@justsendit.ai · +49 151 65140425
Referred to below as "JustSendIt", "we" or "us". You are "the Customer" or "you".
These Terms govern your use of JustSendIt. By creating an account or connecting an AI client to our MCP server, you agree to them. Conflicting or supplementary terms of your own do not apply unless we have agreed to them in writing.
JustSendIt is offered to both consumers and businesses. Where a clause applies only to one group it says so. "Consumer" means a natural person acting for purposes outside their trade, business or profession (§ 13 BGB); "Business customer" means anyone else (§ 14 BGB).
2. What the service is
JustSendIt is a hosted Model Context Protocol (MCP) server and accompanying web application that lets you and your AI assistants read and send messages through messaging accounts you own — for example an email mailbox or a LinkedIn account — through a narrow, permissioned interface.
JustSendIt is a relay, not a mailbox provider. We do not store your messages (see the Privacy Policy). Delivery, deliverability and the availability of your underlying accounts remain the responsibility of the respective providers.
The functional scope depends on your plan and on the capabilities the upstream provider exposes at the time. Capabilities may change when an upstream provider changes them; we will notify you if a change materially reduces what your plan does, and section 10 gives you a termination right if it does.
3. How the contract is formed
Presenting plans on our website is an invitation to treat, not a binding offer. The contract for the service comes into existence when you complete checkout and we confirm your subscription. Purchases are concluded through our merchant of record — see section 6. The contract text is not separately stored by us; you receive it with your order confirmation and can always retrieve the current version on our website.
4. Registration and accounts
- You must be at least 18 years old and legally capable of entering into a contract.
- Registration data must be accurate and kept current.
- You are responsible for your credentials and for everything that happens under your account, including actions performed by AI agents you have authorised. Manage this through the permission scopes in the application.
- You may create workspaces and invite collaborators. You are responsible for their use of the service.
5. Connecting third-party accounts
- You may only connect accounts that you own or are authorised to operate.
- Connecting an account requires you to authorise access at the relevant provider. You can revoke that authorisation at any time, both with us and with the provider.
- Your use of those accounts remains subject to the provider's own terms, including Google's and LinkedIn's.
Explicit risk disclosure — LinkedIn and comparable platforms. LinkedIn's User Agreement restricts automated access to the platform. Using JustSendIt to read or send LinkedIn messages may breach that agreement and can result in your LinkedIn account being restricted, suspended or permanently banned. This risk is real, it is not theoretical, and it is not something we can prevent, insure against or reverse. You use the LinkedIn functionality at your own risk. We give no warranty that it will remain available, and we are not liable for the loss of an account, of contacts, of a profile or of any commercial opportunity connected to one. If that risk is unacceptable to you, use the email functionality only.
If a provider blocks, rate-limits or removes an integration, the affected functionality may stop working. That is outside our control and is not a defect for which we are liable, though it may give you a termination right under section 10.
6. Fees, payment and the merchant of record
6.1 Prices
Current prices are those shown on our pricing page at the time of purchase. Prices shown to consumers are total prices including statutory VAT as required by the German Price Indication Ordinance (PAngV). Business customers may be shown net prices, clearly marked as such.
6.2 Merchant of record
Subscriptions are sold through our merchant of record:
Armitage Labs OÜ (trading as Creem), registry code 16977866, Rotermanni 14, 10111 Tallinn, Estonia.
Under Creem's Merchant Terms, Creem acts as contractual reseller and merchant of record, concluding the sale with you in its own name, collecting payment, issuing your invoice and remitting transaction taxes. Creem's Buyer Terms therefore govern the purchase transaction, including the consumer right of withdrawal (see section 7).
These Terms govern the service: what JustSendIt does, what you may use it for, and our respective liabilities. We remain responsible for delivering the service, for it performing as described, for customer support, for deciding refund eligibility, and for honouring your consumer rights and remedies. Refunds and chargebacks are executed by Creem on our determination.
In short: ask us about the product, and about a refund. Creem issues the invoice.
6.3 Billing cycle
Subscriptions renew automatically for the same period until cancelled. Cancellation takes effect at the end of the current billing period. We do not pro-rate unused time unless required by law.
6.4 Late payment and suspension
If a payment fails, we may suspend access after notifying you and allowing a reasonable period to cure. Statutory default interest applies.
6.5 Price changes
We may change prices with at least 30 days' notice before the start of the next billing period. If you do not accept an increase, you may terminate with effect from the date the new price would take effect.
7. Right of withdrawal — consumers
This section applies only to consumers.
Creem (Armitage Labs OÜ) is the seller of record. You may make a statutory withdrawal declaration to Creem or use our [“Withdraw purchase”](/withdraw) function, which is continuously available without signing in. We immediately confirm receipt by email and forward the declaration for review and processing, including any refund that is due.
Early expiry for digital services. Starting the service before the withdrawal period ends does not by itself extinguish the right. The right expires only where every statutory condition is met, including valid express prior consent and the legally required acknowledgement (§ 356 (4) BGB / Art. 16 (m) CRD).
Independently of the statutory right, you can cancel any subscription for the future at any time under section 10, and we will consider goodwill refunds on request.
8. Acceptable use
You must not use JustSendIt to:
- send unsolicited commercial messages without a lawful basis, including in breach of § 7 UWG, the ePrivacy Directive, the CAN-SPAM Act or comparable law in the recipient's jurisdiction;
- send spam, phishing, malware, or deceptive, harassing, defamatory or unlawful content;
- impersonate another person or organisation, or falsify sender information;
- scrape, harvest or resell personal data obtained through the service;
- circumvent rate limits, quotas, permission scopes or security controls;
- resell or sublicense the service without our written agreement;
- use the service in a way that endangers our access to an upstream provider.
You are responsible for the lawfulness of your outreach. We do not review your content and do not check your legal basis for contacting anyone. On a credible abuse report or a provider complaint, we may suspend the affected account or workspace immediately, with notice as soon as reasonably possible.
9. Availability
We aim for high availability but do not offer a contractual uptime SLA on standard plans. Maintenance windows, upstream provider outages and force majeure may interrupt the service. Planned maintenance is announced where practicable.
10. Term and termination
- Contracts run for the billing period chosen at purchase and renew automatically.
- Either party may terminate at the end of a billing period.
- Consumers may cancel at any time without signing in using [“Cancel subscription”](/cancel-subscription). The function leads to a confirmation page containing the required details and the final button “Cancel now”. Receipt is confirmed immediately by email.
- We may terminate for good cause without notice (§ 314 BGB), in particular for a serious breach of section 8, non-payment after a grace period, or where continuing to serve you would endanger our access to an upstream provider.
- On termination, access ends and account data is deleted or anonymised in line with the Privacy Policy.
11. Intellectual property
- We retain all rights in the JustSendIt software, brand and documentation. You receive a non-exclusive, non-transferable, revocable right to use the service for the duration of your subscription.
- You retain all rights in your content and data. We claim no ownership of anything that passes through the relay.
- If you send us feedback or suggestions, we may use them freely and without obligation.
12. Warranty and liability
12.1 Warranty
Statutory warranty rights apply. The service is provided on the basis of the functionality described at the time of purchase.
12.2 Liability
- We are liable without limitation for damages arising from injury to life, body or health; for intent and gross negligence; under the German Product Liability Act; and where we have given a guarantee.
- For slight negligence we are liable only for breach of a material contractual obligation (Kardinalpflicht) — an obligation whose fulfilment makes proper performance of the contract possible at all and on whose observance you may regularly rely. Such liability is limited to the typical, foreseeable damage, and in any event to the fees paid in the 12 months preceding the event.
- We are not liable for lost profits, lost business opportunities, damage to your sender reputation, or the restriction, suspension or termination of your account by a third-party provider (see section 5).
- These limitations do not apply where mandatory law provides otherwise, in particular in favour of consumers.
12.3 Indemnity — business customers only
Business customers indemnify us against third-party claims arising from their unlawful use of the service, in particular claims under § 7 UWG, data protection law or a provider's terms, unless they are not responsible for the breach.
13. Data protection
We process personal data as described in the Privacy Policy. Where we process personal data on your behalf — including the personal data of the people you contact — our Data Processing Agreement applies and forms an integral part of these Terms.
14. Changes to these Terms
We may amend these Terms where necessary for legal, regulatory, security or product reasons. We will notify you at least 30 days in advance by email or in-app. If you object before the change takes effect, either party may terminate with effect from that date. Silence for 30 days following a notice that expressly states this consequence counts as acceptance.
15. Final provisions
- Governing law: the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not deprive you of the mandatory protections of the law of your country of habitual residence.
- Jurisdiction: if you are a merchant, a legal person under public law or a special fund under public law, the exclusive place of jurisdiction is Munich, Germany. For consumers, statutory jurisdiction applies.
- Severability: if any provision is or becomes invalid, the remainder stays in force.
- Language: these Terms exist in German and English. The German version is binding; the English version is a convenience translation. In case of discrepancy the German text prevails.
- Consumer dispute resolution: the former European Online Dispute Resolution platform was discontinued on 20 July 2025. The European Commission publishes information about recognised consumer dispute resolution bodies at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. We are neither obliged nor willing to participate in proceedings before a consumer arbitration board.
